Section 535.65(h) requires the examination to be given in the manner approved by the Commission, questions to be kept confidential and significantly different from any quiz questions and exercises used in the course, no student to view or take it before completing regular course work, all versions to be rotated through the approval period in a manner acceptable to the Commission at an unweighted passing score of 70%, and administration under conditions ensuring the examinee is the student who registered for and took the course. Section 535.65(i) permits one subsequent examination only after additional course work prescribed by the provider, no later than the 90th day after the original class concludes, on a different version; no credit may be given to a student who fails both. CONFLICT RECORDED, NOT RESOLVED: the rule's own cross-references disagree about which paragraph carries the four-versions requirement — § 535.65(h)(4) cites § 535.62(b)(7) while § 535.65(i) cites § 535.62(b)(8), and the requirement itself sits at (b)(8) in both held copies. StateCourse's administration method remains a provider proposal until TREC approves it; no examination may be administered before then. Read from TREC's published reproduction of 22 TAC Chapter 535, with the subsection lettering confirmed against the Secretary of State's Texas Register publication of the §§ 535.62/535.65 proposal (TRD-202601975, 22 May 2026).
